At Colorby (hereinafter referred to as "we," "us," or "our"), we understand how important your personal data is. We are committed to protecting your privacy and handling your personal information in accordance with applicable laws and regulations.

We process your personal data based on lawful grounds such as legal obligations, contract performance, your consent, public interest, and legitimate interests. Please read this Privacy Policy (hereinafter referred to as the "Policy") carefully to understand what information Colorby collects and how we use it. 1. Information We Collect

1.1 Colorby requires access to your photo library to provide editing and related features. We will always request and obtain your permission beforehand. This access is used strictly for service functionality.

1.2 Unless explicitly authorized by you, Colorby does not upload your photos to any server. Your photos remain stored locally on your device.

1.3 To improve product quality and user experience, we may collect non-personally identifiable information, such as feature usage data, request times, cookies, IP address, browser language, and device type. This data cannot identify you and is used solely for analytics, service improvement, performance monitoring, and marketing insights.

1.4 When you contact us for support or feedback, you may voluntarily provide us with information such as your name, email address, and request content. We use this information only to respond to your support inquiries and to prevent abuse. We will obtain your explicit consent before using such data for other purposes.

1.5 To evaluate ad performance, re-engage inactive users, or promote Colorby to a broader audience, we may collect device identifiers, such as IDFA or AAID, and interaction data. This helps us improve the relevance and effectiveness of our advertising. IDFA (iOS/iPadOS) and AAID (Android) are advertising identifiers provided by your device operating system. You can disable tracking via system settings.

1.6 To comply with Apple App Store's privacy label requirements, we categorize our data collection as follows:

  • Product Functionality: Photo access is required for core features such as image editing. Unless explicitly authorized, data is processed locally, not uploaded, not linked to you, and not used for tracking.
  • Analytics & Improvement: We collect anonymous usage behavior, crash logs, and performance metrics for optimization. Data is not linked to users and not used for tracking.
  • User Support: Contact information, such as email, provided for support requests is used solely to respond to your inquiries. It may be linked to you but is not used for tracking.
  • Advertising & Marketing: Device identifiers, such as IDFA or AAID, may be used for ad attribution and re-engagement. This data may be linked to you and used for tracking. If you wish to opt out of ad tracking, you can disable it in iOS via Settings > Privacy > Tracking.

2. Data Protection

2.1 We do not disclose or share your personal information with any third party unless:

  • With Your Explicit Consent: We may share your personal information with third parties with your explicit permission. These parties are contractually obligated to follow our instructions and comply with this Policy.
  • Legal Compliance: We may disclose your information if required by laws, legal processes, or government or judicial authorities.
  • Public Interest or Safety: We may disclose your information when necessary for national security, law enforcement, or other matters of public importance.
  • Protection of Rights: We may share your information if necessary to protect the rights, property, or safety of Colorby, our users, or the public.

2.2 We retain your personal data only for the duration necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required by law. Afterward, we will delete or anonymize the data.

2.3 In the event of a merger, acquisition, or sale of Colorby assets, you will be notified before your personal data is transferred and becomes subject to a different privacy policy.

2.4 We implement reasonable technical and organizational measures to protect your data against loss, misuse, or unauthorized access. However, no system can guarantee absolute security, and we cannot be held responsible for breaches beyond our control.

2.5 In the unfortunate event of a data breach, we will notify you in accordance with legal requirements and take prompt action to mitigate risks and prevent recurrence.

2.6 Upon verifying your identity and as permitted by law, you may request the deletion of your personal data. Once deleted, the information cannot be recovered.
